Terms of Service

1. Acceptance of Terms

By accessing or using PawReport ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. We may update these Terms at any time; continued use after changes constitutes acceptance.

2. Description of Service

PawReport is a platform operated by Bybloscale LLC that enables pet care facilities (daycares, kennels, groomers, trainers, and veterinary clinics) to:

• Create and send daily report cards to pet owners via SMS
• Collect and manage pet information and visit records
• Request and track Google reviews from satisfied pet owners
• View facility analytics and dashboard metrics

3. Account Registration

To use the Service, you must create an account with a valid email address and password. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must provide accurate, current, and complete information during registration.

4. Subscription & Billing

PawReport offers a paid subscription at $129 per month per facility. A 7-day free trial is available for new accounts — no credit card required. By subscribing after your trial, you authorize Bybloscale LLC to charge your payment method on a recurring monthly basis. You may cancel at any time through the billing portal; cancellation takes effect at the end of the current billing cycle. Refunds are not provided for partial months.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or to violate any applicable laws
• Send unsolicited or spam messages through the SMS features
• Upload content that is harmful, offensive, or infringes on others' rights
• Attempt to gain unauthorized access to any part of the Service
• Use the Service to collect personal data without proper consent
• Resell, sublicense, or redistribute the Service without written permission

6. SMS Messaging

PawReport sends transactional SMS messages on behalf of pet care facilities to the pet owners who have opted in through those facilities. Detailed documentation of the SMS opt-in flow, including a sample intake form and verbal disclosure script, is published at https://pawreport.co/sms-consent.

6.1 How pet owners opt in

Opt-in happens at the pet care facility, in person, when a pet owner enrolls their pet or checks in for a visit. Facility staff request the pet owner's mobile phone number as part of the standard intake or check-in form, and verbally inform the pet owner that PawReport will send SMS report cards about their pet's visits, that message and data rates may apply from their carrier, and that they can reply STOP at any time to opt out. Pet owners may decline at this point and provide an alternative contact method — there is no requirement to enroll in SMS to use the facility. Once a pet owner provides their phone number with this disclosure, the facility records the consent in PawReport as part of the pet's profile, and only then does PawReport begin sending SMS to that number.

PawReport does not buy, rent, scrape, or otherwise acquire phone numbers from third-party sources. Every SMS recipient is a pet owner who has provided their phone number directly to a participating facility with full disclosure of how it will be used.

6.2 Facility obligations

By using PawReport's SMS features, facilities (PawReport customers) confirm that:

• They have obtained explicit consent from each pet owner to receive SMS messages about that pet's visits, with the verbal or written disclosure described in Section 6.1 and at /sms-consent
• Pet owners provided their phone numbers voluntarily at enrollment or check-in, with a meaningful opportunity to decline
• They will honor opt-out requests promptly and will not re-add a recipient who has replied STOP
• They will not use the SMS features for marketing, promotional content, sweepstakes, contests, or messages unrelated to a specific pet's care at their facility
• They are responsible for compliance with applicable laws in their jurisdiction (including TCPA in the United States, GDPR in the European Union, and PIPEDA in Canada)

Facilities that violate these obligations are subject to immediate suspension of SMS sending privileges and potential termination of their PawReport account.

6.3 Pet owner disclosures

For pet owners (SMS recipients): You will receive PawReport SMS messages from pet care facilities where your pet is enrolled. Messages contain a link to your pet's daily report card and occasional review requests for the facility. Message frequency depends on how often your pet visits — typically 1 to 5 messages per week per pet. Message and data rates may apply from your carrier. PawReport does not charge you for these messages.

• Reply STOP at any time to unsubscribe from all PawReport messages. Opt-out is honored immediately and globally across all facilities. Other recognized opt-out keywords: CANCEL, END, QUIT, UNSUBSCRIBE, REVOKE, OPTOUT, STOPALL.
• Reply HELP for assistance, or contact support@pawreport.co.
• PawReport does not share your phone number with third parties, advertisers, data brokers, or marketing platforms, and does not use it for marketing of any kind.
• You can confirm whether your phone number is enrolled by contacting the pet care facility directly.

PawReport is not responsible for carrier fees incurred by message recipients. PawReport sends SMS through Twilio under a registered A2P 10DLC campaign reviewed and approved by mobile carriers in the United States, and all messages comply with the CTIA Messaging Principles and Best Practices and the Telephone Consumer Protection Act (TCPA).

7. Content & Data Ownership

You retain ownership of all content you upload to PawReport, including photos, notes, and facility information. By uploading content, you grant Bybloscale LLC a limited license to store, process, and transmit that content solely for the purpose of providing the Service. We do not sell your content or use it for advertising.

8. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your data. By using PawReport, you consent to the practices described in the Privacy Policy.

9. Intellectual Property

The PawReport name, logo, design, and all associated software are the intellectual property of Bybloscale LLC. You may not copy, modify, distribute, or create derivative works based on the Service without prior written consent.

10. Service Availability

We strive to keep PawReport available at all times but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We are not liable for any loss or damage resulting from service interruptions.

11. Limitation of Liability

To the maximum extent permitted by law, Bybloscale LLC and its officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless Bybloscale LLC from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

13. Termination

We may suspend or terminate your account at any time if you violate these Terms or engage in activity that harms the Service or other users. You may close your account at any time by contacting us. Upon termination, your right to use the Service ceases immediately. We may retain data as required by law.

14. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any disputes shall be resolved in the courts located in Delaware.
